Your membership and what it renews

Your membership is monthly. It starts on the day you pay and renews automatically on the same date each month, at the same price, until you cancel it. There is no minimum term and no contract to see out. If your start date does not exist in a later month, such as the 31st, that month bills on its last day. Founding rate memberships are held at the price you joined at for as long as you keep the membership without a break. If you cancel and rejoin later, you rejoin at whatever the price is then.

Cancelling

You can cancel at any time from the billing page of your member portal. It takes one click and it does not require you to phone, email or ask anyone. Cancelling stops the next payment. Your access runs to the end of the period you have already paid for, and then stops. We do not charge a cancellation fee and we do not refund part months.

Your right to cancel this agreement

You may cancel this agreement, without penalty and without giving a reason, at any time before midnight of the fifth business day after the day you signed it. To cancel, tell us in writing at the email address on this page, or cancel from your member portal. If you cancel within that period we refund everything you have paid, less the value of any classes you have already attended. You may also cancel and receive a pro rata refund if you die, if you become disabled in a way that stops you using the gym for more than one month, or if you move more than 25 miles from the gym and we cannot transfer your membership to a comparable facility. We may ask for reasonable proof.

Prices and changes

We will give you at least 30 days notice by email before changing the price of an existing membership, and you can cancel before the new price takes effect. A price change never applies to a payment you have already made. We may change these terms, the timetable, the coaching roster and the class formats. If a change to these terms is material we will email you before it takes effect.

Payments and failed payments

Card payments are handled by Stripe. We never see or store your full card number. Keeping a valid card on file is part of holding a membership. If a payment fails, Stripe retries on its own schedule and we email you. If it keeps failing your access pauses until the balance is settled, and if it stays unsettled we may cancel the membership. Chargebacks raised without contacting us first cost the gym more than the payment does, so please email us first. We will sort out anything that is genuinely our mistake.

Assumption of risk

Muay Thai is a full contact combat sport. Training involves striking and being struck, kicking, kneeing, elbowing, clinching, takedown defence, falls, sudden movement, physical contact with other people, and the use of pads, bags, gloves and other equipment. Injury is a foreseeable and normal part of it. Risks include, and are not limited to, bruising, cuts, sprains, dislocations, broken bones, dental injury, eye injury, concussion and other head injury, heat illness, heart events, permanent disability and death. Those risks cannot be removed by supervision, by equipment or by care, and you accept them knowingly and voluntarily as a condition of training here.

Release of liability

In exchange for being allowed to train, you release Eight Combat, its owners, coaches, staff, contractors and landlords from liability for any injury, illness, death, or loss of or damage to property arising out of your training, your use of the facility and its equipment, or your presence on the premises, including where that arises from ordinary negligence. This release does not apply to gross negligence, to reckless or intentional misconduct, or to anything that cannot lawfully be released. You agree not to bring a claim covered by this release, and you accept responsibility for loss or damage you cause to the gym or to another person there.

Your health, and telling us about it

You confirm you are in good enough health to take part in strenuous physical activity and that no doctor has told you otherwise. You will tell a coach before class about any injury, illness, pregnancy, recent surgery, concussion, heart condition, breathing condition, or medication that could affect your training or anyone else's safety, and you will tell us if that changes. Stop and tell a coach if you feel unwell, dizzy, short of breath or concussed. If we reasonably believe it is not safe for you to train we can ask you to stop until a doctor clears you. We are not responsible for medical care and we strongly recommend your own health insurance.

Head injury

Concussion is treated seriously and is not negotiable. If you are concussed, or a coach believes you may be, you stop training immediately, you do not spar, and you do not return until a medical professional has cleared you in writing. Hiding a head injury from a coach puts you and your training partners at risk and is grounds for ending your membership.

Sparring

Sparring is never compulsory and is never open to everyone. You spar only when a coach has said you are ready, only in sessions a coach is running, only with partners a coach has paired you with, and only with the protective equipment they require. Sparring is controlled practice, not a fight. Going too hard, ignoring a partner who asks you to lighten up, or deliberately hurting a training partner ends your membership on the spot with no refund.

Conduct and the room

Respect the coaches, your training partners and the space. No ego, no intimidation, no discrimination, no harassment of any kind, no drugs, no training under the influence of alcohol or drugs, no weapons, no filming another member without their agreement. Follow coach instruction at all times. Arrive clean, with short nails and no jewellery. We can suspend or end a membership without refund for behaviour that makes the room unsafe or unwelcoming, and we do not owe a warning first where the behaviour is serious.

Booking, cancelling and late cancellation

Places in class are booked through the portal and are limited by the size of the mat. Cancel a place you cannot use so somebody on the waitlist can take it. Cancelling inside the notice period shown on the class, or not turning up at all, may incur the late cancellation fee shown at the time of booking. If the gym cancels a class, nobody is charged a fee and any credit taken for it is returned.

Private sessions and class packs

Private sessions and class packs are paid for up front and are drawn down as you use them. They are personal to you, cannot be transferred or exchanged for cash, and are not refundable once used. Unused sessions stay on your balance and do not expire unless we tell you otherwise in writing before you buy.

Under 18s

Anyone under 18 trains on a kids membership, signed up by a parent or legal guardian, who must also sign the separate release of liability for minors before that child sets foot on the mat. The parent or guardian is responsible for the child's conduct, their fees, and their collection from class. Children are supervised during class and are not supervised before or after it.

Your belongings

Bring as little as you can. The gym is not responsible for loss of or damage to personal property anywhere on the premises, including in any locker or storage area, however it happens. Lockers are for use during class only and anything left overnight may be cleared.

Photography and media

We photograph and film in the gym for our own social media and marketing. If you would rather not appear, tell a coach or email us and we will keep you out of it and take down anything already posted that you ask us to. We do not sell your image and we do not use it to endorse anything outside the gym.

Your details and your privacy

We use your name, email, phone number and training records to run your membership, take payment and tell you about classes and changes. Payment details are held by Stripe, not by us. We do not sell your data and we do not share it except with the services that run the gym, such as our payment processor and our email provider. You can see and correct your details, or switch off marketing email, from your profile at any time, and you can ask us to delete your account by email. Some records, such as payment history, are kept as long as the law requires.

Closures and things outside our control

The gym may close for public holidays, maintenance, private events, or events outside our control such as fire, flood, power failure, public health orders or the loss of the premises. We publish closures in advance where we can. Short closures do not change your membership. If a closure runs long enough that the membership stops being worth what you pay for it, we will credit or pause your billing.

If part of this is unenforceable

If a court finds any part of these terms unenforceable, that part is limited or removed to the smallest extent needed and the rest stays in force. Failing to enforce something once does not waive it later. These terms, together with any waiver you sign, are the whole agreement between you and the gym.

Governing law

These terms are governed by the law of the State of California. Any dispute is brought in the state or federal courts serving Orange County, California, and you and the gym both agree to that. Before filing anything, email us and give us 30 days to put it right, because almost everything is fixable that way.
